Please Read Carefully: By downloading, installing, accessing, or using CouchDeck, you agree to be legally bound by these Terms of Use. If you do not agree to these terms, do not install or use the Application.

1. Acceptance of Agreement

These Terms of Use ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you") and Ticherhaz ("Developer", "we", "us", "our"). These Terms govern your access to and use of the CouchDeck mobile and Android TV application (the "Application").

2. Description of the Application

CouchDeck is an independent, general-purpose utility software application providing:

• TV Screen Mode: A standard embedded web browsing and HTML5 media surface for smart TVs and Android TV boxes utilizing the official Android System WebView.
• Remote Control Mode: A companion controller for handheld mobile devices featuring a virtual touchpad, keyboard input transmitter, multi-client cursor capabilities, virtual gamepad overlay (standard W3C Gamepad API emulation), and HTML5 media playback controls over a private local Wi-Fi network.
• Browser Assistive Tools: User-configurable browsing utilities including an optional local pop-up and third-party ad-tracker domain filter, TV night mode CSS dimmer, desktop browser user-agent toggle, custom home page URL, and incognito private browsing.

3. License Grant and Acceptable Use Restrictions

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Application on compatible Android devices owned or controlled by you solely for lawful, personal, non-commercial purposes.

You agree not to:

• Decompile, reverse engineer, disassemble, decrypt, modify, or attempt to derive the source code or cryptographic keys of the Application;
• Rent, lease, lend, sell, redistribute, repackage, or commercially exploit the Application;
• Use the Application to access, stream, download, or distribute copyright-infringing, pirated, or unlawful content;
• Use the Application to violate the Terms of Service of any third-party website or online platform you visit;
• Use the Application to probe, scan, or attempt unauthorized connections to local network devices that you do not own or have explicit permission to control;
• Bypass, disable, or tamper with any licensing safeguards, entitlement verifications, or security mechanisms implemented within the Application.

4. In-App Advertising (Free Version)

The free version of the Application displays third-party banner advertisements on mobile control screens and occasional interstitial advertisements delivered by Google Mobile Ads (AdMob):

• Interstitial advertisements are presented only during natural user-initiated transitions on mobile devices (such as after saving a bookmark or switching modes) with a minimum 60-second cooldown interval.
• We do not endorse or control the specific third-party products or services advertised. Any dealings you have with advertisers found on or through the Application are solely between you and the advertiser.
• Users may remove all in-app banner and interstitial advertisements by subscribing to CouchDeck Premium.

5. Push Notifications & Feature Communications

The Application may deliver optional system push notifications powered by Google Firebase Cloud Messaging (FCM) to inform you of software updates or feature announcements:

• Push notifications are strictly optional. On supported Android versions (Android 13+), notifications require your explicit runtime permission.
• You may opt out of or adjust your notification preferences at any time through your Android device settings under Settings > Apps > CouchDeck > Notifications.
• Disabling notifications does not restrict or affect your ability to use the local remote control, trackpad, gamepad, or TV browsing features.

6. Neutral Browser Conduit & Third-Party Content Disclaimer (DMCA / Safe Harbor)

The Application functions strictly as a neutral, user-directed web browser and local input peripheral (similar to a standard web browser and wireless mouse/keyboard):

• No Hosted or Curated Media: The Application defaults to a blank page (about:blank) on TV and does not host, provide, index, aggregate, link to, or curate any movies, television broadcasts, live streams, or copyrighted media files.
• User Responsibility: You alone choose which URLs and websites to visit. You are solely responsible for ensuring your browsing activities comply with applicable laws and the terms of service of any website you access.
• No DRM Circumvention or Media Downloading: The Application does not rip, record, download, or archive audio/video streams from any website, nor does it bypass or decrypt Digital Rights Management (DRM / Widevine) or subscription paywalls.

7. Browser Content Filtering & Assistive Customization Tools

The Application offers optional browser customization tools, including a local pop-up/ad-tracker host filter, desktop user-agent toggle, and night dimmer:

• These tools operate locally within your TV's WebView solely for user privacy, viewing comfort, and page layout formatting.
• We make no representations or warranties that the content filter will block all unwanted pop-ups or that all third-party websites will function identically when content filtering or desktop mode is enabled. If a website does not render as expected, you may toggle these options off in Remote Settings.

8. Intellectual Property & Non-Affiliation Disclaimer

All intellectual property rights in and to CouchDeck—including its original source code, UI design, custom vector icons, and documentation—are owned exclusively by Ticherhaz.

Independent Product & Non-Affiliation Notice: CouchDeck is an independent utility software product developed by Ticherhaz. It is not affiliated with, associated with, authorized by, sponsored by, or endorsed by Valve Corporation (owners of the Steam Deck trademark), Corsair Gaming, Inc. / Elgato (owners of the Stream Deck trademark), Google LLC (owners of the Android, Google TV, and Google Play trademarks), or any television manufacturer or streaming service provider. All third-party trademarks, product names, and company names mentioned in documentation are the property of their respective owners and are used strictly for descriptive compatibility identification.

9. In-App Purchases, Subscriptions, & Refunds

Optional auto-renewing subscription plans ("CouchDeck Premium" — Monthly and Yearly Access) are available to unlock Pro features, including: (1) 100% Ad-Free Remote, (2) Unlimited Bookmarks, (3) Web Ad & Pop-up Filter, (4) Incognito Private Browsing, (5) Custom TV Home Page, and (6) Desktop Mode & Night Dimmer:

• Billing & Pricing: All purchases and subscriptions are processed exclusively by Google Play In-App Billing. Exact prices in your local currency are displayed on the subscription sheet and within the Google Play checkout dialog prior to purchase.
• Automatic Renewal & Cancellation: Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled in your Google Play Store account (under Settings > Payments & subscriptions > Subscriptions) at least 24 hours before the end of the current billing cycle. Uninstalling the Application does not automatically cancel an active Google Play subscription.
• Refunds: All billing inquiries and refund requests are governed by Google Play's official refund policies.

10. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL OPERATE UNINTERRUPTED, BE ERROR-FREE, OR BE COMPATIBLE WITH ALL WI-FI ROUTERS (SUCH AS NETWORKS WITH AP/CLIENT ISOLATION ENABLED), TELEVISION HARDWARE, OR THIRD-PARTY WEBSITES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR HARDWARE MALFUNCTION) ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ticherhaz from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Application; (b) your violation of these Terms; (c) your violation of any applicable law or third-party terms of service; or (d) any content or websites you access, transmit, or interact with using the Application.

13. Governing Law, Severability & Entire Agreement

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country of residence. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Modifications & Termination

We reserve the right to update these Terms from time to time. Updated Terms will be included in Application updates and posted with a revised "Last Updated" date. You may terminate this Agreement at any time by cancelling any active subscription and uninstalling the Application.
